What is Tax Lien?
The tax lien is nothing but a lien on a property which has an outstanding tax amount on it. The Internal Revenue Service is the US nation’s tax collection agency regularly checks the tax payment details of every property. If any taxpayer forgot or refuse to pay the property taxes, they will attach a lien against their property. These liens have a certain period of validity. The property owner must pay their pending taxes within that period to get rid of the lien otherwise it will be sold to the investors.
Invest in Tax Lien Not Tax Levy
Both the tax lien and tax levy are the property-based investments but have some difference. In tax lien, if the property owner must pay their pending taxes with the interest to the investor in the given period of time. The investor will get sure profit in this method. But in the tax levy, if the property owner did not pay their pending taxes within the time, the investor will become the owner of that property. If the invested amount was high than the property value, heavy loss occurs to the investor.
Tax Lien Investing
All the tax lien properties are finally sent to the auction process. First, a tax lien certificate is generated for each lien based on the tax amount owed by the taxpayer. Then, the property details will be made public by publishing it on the IRS official website and local newspapers. Investors look at these details and join in the auction if they are interested. In the auction, the investors bid their amount their amounts based on the value of the certificate. The IRS chose only one investor who bid the maximum value for the property and minimum amount for interest as a winner. The investor can now invest in the property by paying all the pending tax amounts.

It’s one of the scarier terms in the Internal Revenue Service’s lexicon: tax lien. If you owe taxes and haven’t been able to pay them, you may have one – or live in fear of one.
So what does it mean to have a tax lien attached to your property? Here’s what you need to know:
What is a tax lien? Simply put, it’s a document filed with the county government alerting the general public that you have an unpaid debt. If the property is sold, the government debt you owe will be paid and you’ll get the rest of the money.
The types of tax liens vary. You could have a federal tax lien on your house, but you could also have a state tax lien or a tax lien from your county or city. There‘s also the “super lien,” which involves being behind on homeowner association fees. And you aren’t alone if you have a tax lien: In fiscal year 2012, the IRS filed over 708,000 Notices of Federal Tax Liens.
How serious are tax liens? The answer you’ll get depends on whom you talk to and how much you owe. “In general, I would probably rather have an IRS tax lien on me than a state municipal one right now,” says Fred Croop, a certified personal accountant and dean of professional studies and social sciences at Misericordia University in Dallas, Pa. He hastens to add: “To be clear, I don’t have any [tax liens].”
That isn’t to say a federal tax lien isn’t serious. But the IRS, for all the fear it instills in taxpayers, is well known for working with those who owe a lot of back taxes. If you also owe taxes to a smaller government entity, such as your state or municipality, it can be an even bigger problem. In some states, as crazy as it sounds, people have lost homes for owing just a few hundred dollars in back county and city taxes. As a general rule, you should worry about paying back the smaller government debts first.
When it comes to state tax liens, “the specifics vary so much [from state to state] and are pretty fluid right now,” Croop says, adding that in Pennsylvania, where he lives, a new and much tougher property owner act went into effect in January. It used to be that a municipal lien in Pennsylvania attached to a person’s specific property – but now it attaches to any other property the person owns in the same county.
“What states and local governments will do to collect their moneys in these times of increasing budget shortfalls is very dynamic,” Croop says.
“It is extremely serious. You could lose your property,” says Rafael Castellanos, managing partner at Expert Title Insurance Agency LLC in New York City. But he is referring to a municipal tax lien. “If you don’t pay your property taxes, that’s deadly. You’re going to lose your house,” Castellanos says.
If you have a federal tax lien, in most cases, you have much more time to work things out, and the likelihood of keeping your house goes up considerably. But it is a financial inconvenience, to say the least. Your credit score will likely take a hit, possibly dropping as much as 100 points, according to a 2010 Congressional testimony by Nina Olson, who leads the Taxpayer Advocate Service, an independent organization within the IRS.
But if you ever get a tax levy, that’s another story. “A lien is simply a legal claim against the property. A levy is a legal seizure that actually takes the property to satisfy the tax debt,” says Sharon Lassar, certified public accountant and professor of accountancy at the University of Denver.
You don’t want a levy. “A lien on what you have is bad enough, but receiving later in the process a Notice of Intent to Levy and Notice of Your Right to a Hearing means you are now in deep – fill in your own word,” Croop says.
Even if your house isn’t taken, other assets could be, according to Lassar. “If a taxpayer refuses to pay an amount owed, her wages, bank account, other federal payments, house, car or other property may be levied,” she says.
Avoiding liens. Contact the number on the paperwork you receive informing you that you owe money to the government. You may be able to work out something better than you expect. For instance, sometimes the IRS will allow subordination, which lets other creditors like financial lenders take their debts before the IRS. This can make it easier to get a loan or mortgage. Sometimes the IRS will also allow an Offer in Compromise, which allows the taxpayer to satisfy the debt with a smaller amount.
“It only makes matters worse to ignore the notices,” Croop says. If you can work out an installment agreement with the IRS or your state or municipality to pay the back taxes slowly over time, you may even avoid a lien. And if you do get one, at least you’ll be making the debt smaller and getting out of the hole sooner.

Nov. 30 is the deadline for making your first installment payment for Bexar County real estate taxes, which inspires today’s topic: tax liens.
As a finance writer, all of real life is merely raw material for finance lessons, so I beg your pardon while I talk about tax liens in my life.
A while back in this space, I described my astonishment at how low property taxes were for “agricultural exemption” property that I happened to be eyeing for investment purposes. Long story short, I ended up buying a one-fifth interest in raw land in rural Bexar County, agricultural exemption included.
My property investment
This same property investment now makes its second appearance here, this time to illustrate the role of tax liens. Bear with me for a bit as I explain a sort of complicated situation.
I only bought one-fifth of the property, while the other four-fifths remain owned by four siblings (not mine) who inherited the property. While the family dynamic is opaque to me (they were strangers to me before my investment), I understand that some siblings have sufficient money and some don’t, and some siblings care to pay attention to details such as property taxes, and some don’t. Meanwhile, taxes on the parcel of land have gone unpaid for a few years.
This makes me extremely nervous for my investment.
Fail to pay property taxes, and you eventually run the risk of losing your property to the foreclosure power of the taxing authority, typically a city or town. Needless to say, I don’t want to lose this property, and if we leave taxes unpaid for too long, eventually Bexar County will take the land.
Tax lien lenders
Now, you may or may not have ever heard of “tax lien” lenders and investors, so if not, let me be the first to illuminate for you a fascinating little section of the real estate finance world.
Ever since I registered my name on the property deed as partial owner last spring, I have been inundated with solicitations from tax lien lenders. My name — along with the siblings — shows up publicly as owner of a parcel with delinquent taxes owed. Hence, the solicitations.
The tax lien lenders offer to pay our property taxes now owed on the property. Meanwhile, if we did the deal, the lenders would use the real estate as collateral for the loan in the event I (and the sibling heirs) fail to pay back the loan in the future. Tax lien buyers (or in Texas, tax lien lenders) have the power to act like the municipality, and eventually take over the property for themselves in the event of nonpayment.
In my complicated situation, with some of us owners unable to pay the taxes or possibly unwilling to put up money for the others for an indefinite amount of time, these lenders make some sense.
Partly I mention this whole anecdote because tax lien investing/lending is an obscure but important part of real estate finance.
Partly I mention this because tax lien investing may inspire a natural aversion. On the face of it, any lender who has the power to take away your property seems, I don’t know, scary? I mean, regular bankers seem unlikable enough. From a PR standpoint, however, the specific combined function of “tax collector” and “money lender” has an even tougher time getting a fair hearing. Those labels have served for thousands of years as biblical shorthand for enemies of the common people.
Personally, I have no problem with the solicitations to pay my taxes in exchange for an 8 to 12 percent loan. We might need that solution.
The ironic thing here is that — in my old investing life — I was on the other side of this situation.
My tax lien buying
I discovered tax lien investing in 2005 after buying a book called “The 16 Percent Solution,” in which the author explained a high-return and low-risk path to wealth through tax lien investing. Through my investment company, I first started purchasing liens in New Jersey and New York, eventually branching out into Connecticut, Vermont, Rhode Island and even Mississippi.
Incidentally, I was a very unwelcome (meaning: Yankee) participant in my one Mississippi tax lien auction. I’m just happy to have gotten out of there in one piece.
Tax lien investing and lending happens around the country, with state and local variations adding to the complexity. On the positive side, the interest rates earned seem very attractive, while the risk seems low. On the negative side — as I learned over the course of a few years of tax lien investing — it’s quite easy to lose money through tax lien investing as well.
As I purchased liens, I sometimes wondered about the complex situations that led people to become delinquent on their real estate taxes. Now I’m in one of these complex situations, and I sort of get it.
My situation
I don’t know when we will all be able to agree on paying the taxes. It may be a better idea to borrow the tax money — even if we have to pay 8 to 12 percent on the loan — than to risk losing the property outright to the county via foreclosure. A loan may give us enough time to figure out an eventual solution — either by paying the taxes or selling the property.
